PRIVACY POLICY

This privacy policy (“Policy”) explains the information or data SmackSocial, Inc. (“SmackSocial,” “we,” “us”) collects, how we collect it, how we use and share it, and how we retain it. This Policy covers all of our services, including our mobile application known as “SmackSocial” (the “App”) and our website (the “Website”) (the services provided through the App, Web App, and Website are collectively, the “Service”).
We reserve the right to update this Policy as needed. When we post changes to this Policy, we will update both the Policy’s content (posted on the Website and within the App) and the “Last Updated” field at the beginning of the Policy to indicate when changes were last made. Any changes to this Policy will be announced through a prominently posted notice on the Website or a notification within the App. If you do not consent to any Policy changes after receiving notice of such changes, stop using the Service. Continued use of the Service implies acceptance of such changes.
We recommend reviewing this Policy periodically to be familiar with any updates we may make. By using the Service, you accept and agree to the terms of this Policy.
INFORMATION WE COLLECT
Personal and Non-Personally Identifiable Information: Through the Service, we may collect information such as name, email address, birthdate, and phone number that would allow us to identify individuals personally (“Personal Information”). We also may collect other information (“Non-Personally Identifiable Information”). By using our Service, you authorize us to collect, use, and store data in connection with providing the Service. When you provide Personal Information through the Service, the information may be sent to and stored in servers located in the United States.
Directly Provided Information: Through the Service, we may collect information directly from you. This includes Personal Information. To use the App, you must create a user profile (“Profile”) consisting of your name, username, email address, phone number, profile picture, and birthdate/age (to ensure users are 13+). You will need to sign in with either your Google or Apple login and allow SmackSocial to access certain account information (“Google or Apple Account Information”) such as your profile picture and birthdate. You will be asked to permit SmackSocial to read your phone contacts - this makes the app more useful but it is possible to use the app without granting this permission. As you add phone contacts to Friend-Lists, the phone numbers are collected as number sequences with no other identifiable information. These phone numbers are not shared with third parties and are only used to invite people you specify to events (“Drifts”) via text because they do not have a SmackSocial app account. If you create a Drift and click on the “Current Location” button to auto-fill the location for the event, you will be asked to permit SmackSocial to collect location information from your device while using the app. SmackSocial only accesses your location while auto-filling the Drift location and is not used for any other purpose.
Indirectly Provided Information: We may collect and store any Personal Information you provide during your use of the Service. This may include identifying information, such as your name, email address, and, if you transact business with us, financial information. If you chat with other SmackSocial users, you provide us with the content of your chats. If you create Drifts, you provide us with the details of those Drifts. If you view details of Drifts you were invited to, you provide us with those details. If you contact us, you provide us with the content of that communication.
Information Collected Automatically: We may also obtain information using technologies that gather information as a result of your use of our services, such as usage data, login times, your IP address or device ID, a cache of listings viewed, etc. Examples of technologies that allow us to collect information or data based on your use of our services include cookies, web beacons and similar data collection services or tools.
Information Collected from Third Parties: We may obtain information from third parties who have your permission to share it with us.
Information Collected by Third Parties: We may allow service providers, advertising companies and ad networks, and other third parties to display ads throughout the Service. These companies may use tracking technologies, such as cookies or web beacons, to collect information about users who interact with their ads.
USE OF COLLECTED INFORMATION
We use information and data we collect to operate our business and provide our Service. The following are examples of how we use collected information:

We consider anonymized and aggregated personally identifiable information to be Non-Personally Identifiable Information. We share this Non-Personally Identifiable Information with third parties.
We will not share your Personal Information with third parties except as explicitly allowed by this Policy. We may share any information, including with:

Third party vendors who perform services for us and who agree to keep such information confidential.

Government bodies and law enforcement agencies to comply with the law and cooperate with law enforcement, for example in judicial proceedings, by court order or other legal process.

RETENTION OF COLLECTED INFORMATION
We retain personal data for as long as we reasonably believe is necessary to maintain our business in accordance with this Policy. For example, after you delete your account, we may retain account information for analytical purposes, recordkeeping integrity, to prevent fraud, enforce our terms, or to take any permitted legal action. We may also retain your data for an extended time as required to comply with applicable laws. We will follow reasonable industry standards to protect your data and prevent unauthorized access to your data. No security system, however, is completely secure. Therefore, although we take steps to secure your information, we do not promise, and you should not expect, that your Personal Information or communications will always remain secure. You should handle and disclose your Personal Information with care.
PROTECTING YOUR PERSONAL INFORMATION
When you share Personal Information in your Profile, on Drift details, or in chats or messages with other SmackSocial users, that information will be viewable by other SmackSocial users (for chats, viewable by fellow Drift users; for messages, the specific SmackSocial user you are messaging). We encourage you to use discretion when choosing what Personal Information to disclose. THIRD PARTY SERVICES
When using our Service, you may be able to click on links to access other websites, apps, products, or services (collectively, “third party services”). Our commitment to your privacy does not extend to these third party services you may access through our Service.
This Policy does not cover third-party apps and services nor does it cover links to other websites. We do not control the privacy and security practices and policies of these third parties and their sites. We encourage you to read the privacy statements of the third party apps and websites you use.
RESTRICTED USER ACCESS
We only direct our services inside the United States, and do not knowingly market to any country other than the U.S. Any users that access or use our Service outside of the United States are subject to U.S. privacy laws.
We restrict the use of our service to individuals age 18 and above. We do not knowingly collect Personal Information from children under the age of 13.
